Communication and Presentation Skills in International Dispute Resolution (Oral and Written) 210.010 Seminar 4 Wintersemester 2016/17 Institut für Zivilverfahrensrecht und Insolvenzrecht (Kontakt) Pflichtfach: 6 | Wahlfach: 2 | Doktoratsstudien: 2 Angaben zur Abhaltung The seminar combines „hard“ facts with „soft skills“. On the one hand, the students are required to deal with a selected topic in the field of international dispute resolution (including international insolvency law and international arbitration); on the other hand, they will have to present their work in a real-life situation such as a mock trial, a telephone conference or a client attorney consultation. The presentation will have to be repeated to the point where it is found to be sufficiently effective and convincing.
Participation in a course / seminar dealing with civil procedure, insolvency or arbitration law.
The students are able to effectively present a specific legal subject or a certain legal view in writing and/or orally. They are aware of their role in the specific circumstances and act adequately. They select the most appropriate structure of the written presentation and apply the selected structure. In oral communications, the students express themselves in precise legal terms that are nevertheless clearly understandable for their interlocutor.
Englisch
[English] interactive (e.g. seminar, course: conveying knowledge by presentations, discussions etc.)
The students will be assigned a practical legal problem (e.g., “the conduct of a witness examination in international arbitration”; “the termination of an arbitration by way of an award on agreed terms”; “the validity of an international forum selection clause that is contained in General Terms of Trade”; “the recognition of non-Austrian insolvency proceedings in Austria”). On the basis of the assigned problem, the students have to prepare a written and/or oral presentation (team work) in a specific format, such as a legal memorandum, a letter of information, a powerpoint presentation in combination with a free speech, an oral argument to be delivered in a skype telephone conference. The interim document will be reviewed as to its correctness from a legal point of view. Subsequently, the final document or the final presentation will be scrutinized by all participants (peer review) and tested whether it is effective. The working product will be repeated up until the point where it is found to be convincing.
